Who We Are

The Law Office of David Abney, founded in 2004, is committed to the process of maximizing tort victims’ recoveries by limiting claims for healthcare subrogation claims.


Our staff has over 20 years of experience focused solely on the process of reducing, if not eliminating healthcare liens against third party recovery proceeds. Over the past decade, we have been involved in the resolution of thousands of single event claims from just about every type of health care plan imaginable. Although we initially focused on catastrophic ERISA cases, we have expanded our scope to include lien resolution for Medicare, Medicaid in all 50 states, FEHBA, Tricare, VA, ACA, MEEP, Medicare Advantage, Workers Compensation and occasionally resolve claims involving foreign providers. We also provide opinion letters on complicated health care issues, including whether a Medicare Set Aside is appropriate based on the specific circumstances of a case.

Unlike many who provide lien resolution services, we are not a third party neutral. We are focused solely on ensuring that accident victims retain as much of their settlement as is legally possible. Another thing that sets us apart from others is our dedication to providing the highest level of customer service to our clients. We believe in quick responses and in individual accountability. We understand the time value of money and that no client wants to wait months to disburse settlement proceeds. We strive to get the best possible result in in each case while doing so in the least amount of time possible.


We are not and never will be the largest provider of lien resolution services. We maintain a limited number of cases to ensure that no client gets lost in the shuffle. Our goal is to deliver the best result in each individual case as opposed to attempting to resolve tens of thousands of cases per year. We believe that every case deserves the highest amount of scrutiny.


ERISA health care reimbursement claims present some of the most difficult issues and can often derail a potential tort settlement if not handled properly. 


Unlike other companies that may provide services for CMS or have a financial interest in having settlement funds placed in a Medicare Set Aside, we happily embrace our role as an advocate for the client. 


Medicaid recovery jurisprudence is largely driven by state law, but sound Medicaid lien resolution strategy requires a current understanding of pending federal legislation.
